Class Summary: Navigating Colorado's Legal Landscape for Property Management and Tenant Rights

This course explores Colorado’s legislative framework affecting property management, landlord responsibilities and tenant rights. Key areas include developing comprehensive policies for property operations, legal compliance, and tenant communication.

Recent Legislation Highlights:

  1. Tenant Application and Income Requirements: SB 23-184 restricts landlords from considering certain credit history elements and sets income thresholds based solely on rent costs.

  2. Radon Disclosure: SB 23-206 mandates landlords disclose radon levels and mitigation history to tenants and prospective buyers, with remedies for non-compliance.

  3. Screening Report Acceptance: HB 23-1099 requires landlords to accept recent third-party screening reports, reducing application costs for tenants.

  4. Eviction Protections and Procedures: HB 24-1098 limits eviction to specific justified reasons, introduces mediation for tenants on supplemental assistance, and outlines required notification periods based on tenancy duration.

  5. Warranty of Habitability: SB 24-094 expands landlord duties regarding habitability, requiring timely remediation for uninhabitable conditions and alternative housing for tenants during repairs.

  6. Fair Housing Compliance: Federal and state fair housing laws prohibit discrimination based on race, disability, source of income, and other protected categories.

  7. EPA Lead-Based Paint: Property managers must meet EPA certification and lead-safe work standards, maintain records, and ensure renovator training to avoid fines.

The course includes comprehensive policy and procedure guidance for these laws, covering implementation, tenant communication, and specific protections under Colorado’s Fair Housing and Warranty of Habitability.
